Cloth, $79.95.The stated aim of this collection of thirteen essays (mostly new—four are reprints) by philosophers resident in Australia is to offer selective perspectives on the phenomenological tradition, correcting misunderstandings and highlighting aspects overlooked in (...) standard commentaries. Presumably, it also wants to exhibit contemporary Australian writing in the phenomenological tradition, and situate phenomenological claims in terms graspable by analytic philosophers.Robin Small's introduction, taking Husserl's conception of eidetic intuition as fundamental, sketches the rise of phenomenology. The collection is then divided into three parts. Part One ("Approaching the Sources") focuses on the sources of phenomenology (Husserl and Heidegger) and opens with a thoughtful essay by Max Deutscher, reprinted from the Canadian Journal of Philosophy (1980), which is replied to by Maurita Harney. Three further, not particularly distinguished, essays deal with the issues of realism, relativism, [End Page 422] and the relation between Ryle and Husserl. Part Two ("Following the Tradition") deals with new themes arising in Heidegger, Sartre, and Derrida, while Part Three ("Making Connections") explores the relation between phenomenology and other disciplines, chiefly sociology, anthropology, and literature. A final essay by Jocelyn Dunphy Bloomfield examines the relevance of phenomenology in the Australian context.The collection is interesting but uneven. Some of the essays are out of date: Small's essay on Ryle and Husserl originally appeared in 1981 and Purushottama Bilimoria's paper, "Heidegger and the Japanese Connection," first published in the Journal of the British Society for Phenomenology (1991), is in need of updating given the upsurge of interest in Husserl in Asia in recent years. Deutscher's "Husserl's Transcendental Subjectivity" is helpful in that it introduces Husserl's transcendental idealism through unusually prosaic analogies. He suggests that the transcendental attitude can be grasped in familiar experiences such as "keeping silence" during an awkward or embarrassing moment or adopting a detached or removed stance. An actor on stage can express anger without being angry. The transcendental attitude is such a detached spectator attitude; it is the capacity we have to judge and appraise ourselves (8). Moreover, it is in this attitude that we come to recognize our commitments to others. Deutscher resists the temptation to separate radically the ordinary living in the world from the detached contemplation of it. There never can be total but only intermittent detachment from the life-world; nevertheless the transcendental epoché is important in that it allows us the chance to gain self-awareness about our situation, about our "forms of life." While Deutscher does a terrific job demystifying one of Husserl's central and much misunderstood concepts, he is at risk of oversimplifying and worse of psychologizing Husserl's insights.Richard Campbell's essay on Heidegger's conception of truth as aletheia is also particularly noteworthy in that it is a philosophically sophisticated attempt to cut through Heidegger's somewhat inflated jargon and expresses his central intuitions about truth. Campbell goes to some trouble to elucidate and disambiguate what Heidegger is saying. Furthermore, he believes Heidegger is wrong in his interpretation of Plato; Plato is doing precisely the opposite of what Heidegger says he is doing. Deutscher's essay on Sartre, informed by an analytic rigor and sensitivity to ambiguity, gives a very clear account and partial defence of the relations between positional consciousness of the object and non-positional self-consciounsess. He is critical of Sartre's sweeping concept of the "in itself" and points out that in reality there are many diverse "in-itselves" with different real properties. Crittenden, too, has an interesting essay on Sartre's conception of "the look." Sartre understands the other as the one who looks at (and thereby seeks to objectify me) whereas for de Beauvoir, the other (in the particular case: woman) is the looked at and objectified. Some claim that a commitment to egalitarianism is in tension with support for reparations for historical injustice. This tension appears to arise insofar as egalitarianism is a forward-looking approach to justice: an approach that tells us what kind of world we should aim to build, where that world is not defined in terms of the decisions or actions of previous generations. Some have claimed that egalitarianism thereby renders reparations redundant. One popular option for egalitarians who aim to reject this thesis (...) is to insist that historical injustices demand reparations when they have caused present-day inequality. A promising alternative, skilfully defended by Alasia Nuti in Injustice and the Reproduction of History, is to argue that historical injustices stand in need of repair when they are reproduced into the present-day, such that some past and present injustices are in fact the same injustice. In this paper, I assess these egalitarian responses to the redundancy thesis. I find that Nuti’s account is equipped to reject this thesis, but that the same lines of reply can be adopted by proponents of the causal approach. I suggest that both approaches therefore be viewed as potential ways to conceptualise the relationship between historical injustice and our present normative circumstances; and that in choosing between them, we should understand ourselves to be engaged in an ameliorative project – a project that is guided by, and designed to help us to achieve, our legitimate purposes. To address climate change fairly, many conflicting claims over natural resources must be balanced against one another. This has long been obvious in the case of fossil fuels and greenhouse gas sinks including the atmosphere and forests; but it is ever more apparent that responses to climate change also threaten to spur new competition over land and extractive resources. This makes climate change an instance of a broader, more enduring and - for many - all too familiar problem: the problem (...) of human conflict over how the natural world should be cared for, protected, shared, used, and managed. -/- This work develops a new theory of global egalitarianism concerning natural resources, rejecting both permanent sovereignty and equal division, which is then used to examine the problem of climate change. It formulates principles of resource right designed to protect the ability of all human beings to satisfy their basic needs as members of self-determining political communities, where it is understood that the genuine exercise of collective self-determination is not possible from a position of significant disadvantage in global wealth and power relations. These principles are used to address the question of where to set the ceiling on future greenhouse gas emissions and how to share the resulting emissions budget, in the face of conflicting claims to fossil fuels, climate sinks, and land. It is also used to defend an unorthodox understanding of responsibility for climate change as a problem of global justice, based on its provenance in historical injustice concerning natural resources. In this chapter I consider three different positions on the a priori/a posteriori distinction that have been attributed to Hegel, specifically in the context of the epistemology of the metaphysical claims he defends in his Realphilosophie. I outline and briefly provide evidence for a reading of Hegel that understands him to retain the distinction in question, but to hold that the metaphysical claims he defends in the context of his philosophy of nature and his philosophy of spirit typically involve elements (...) of both a priori and a posteriori knowledge. I then defend this interpretation against two competitors. The first of these also takes Hegel to retain the distinction, but holds that the conclusions of his Realphilosophie, like those of his logic, are principally to be understood as known a priori. The second takes Hegel to abandon the a priori/a posteriori distinction altogether. I argue that these alternatives are less compelling. (shrink)

This paper reconciles an inconsistency between the benefits of mind wandering and a prominent conception of attention in philosophy and cognitive psychology, namely, the prioritization view. Since we prioritize the information in a task less if we are doing it while mind wandering compared to solely concentrating on it, why does our performance in the task sometimes improve when we are mind wandering? To explain this, we offer a conception of diffuse attention that generalizes from external to internal forms of (...) attention and captures deep commonalities between the two (Chun et al. 2011). We conceptualize mind wandering as an instance of internal diffuse attention that also induces diffuse attention in other concurrent tasks. Moreover, pace the prioritization view, certain tasks are in fact better performed with diffuse attention, which prioritizes information less than focused attention. Our account of mind wandering as an instance of the more general category of diffuse attention improves upon current leading philosophical views of mind wandering (such as Irving 2016) by better explaining the interaction between mind wandering and other tasks. A currently popular proposal for fairly distributing emission quotas is the equal shares view, which holds that that emission quotas should be distributed to all human beings globally on an equal per capita basis. In this paper I aim to show that a number of arguments in favour of equal shares are based on a misleading analysis of climate change as a global commons problem. I argue that a correct understanding of the way in which climate change results from the (...) overuse of a global commons shows those who defend equal shares using commons arguments to be harbouring more controversial commitments than might at first appear. I then discuss two options for equal shares theorists who wish to maintain the view in the face of my critique, and attempt to show that one approach holds more promise than the other. (shrink)

Jocelyn Maclure and Charles Taylor provide a clearly reasoned, articulate account of the two main principles of secularism—equal respect, and freedom of conscience—and argue that in our religiously diverse, politically interconnected world, secularism, properly understood, may offer the only path to religious and philosophical freedom.

Land is becoming increasingly scarce relative to the demands of the global economy; a problem significantly exacerbated by climate change. In response, some have suggested that land should be conceptualised as a global commons. This framing might seem like an appealing way to promote sustainable and equitable land use. However, it is a poor fit for the worldʼs land because global commons are generally understood as resources located beyond state borders. I argue that land can be seen to fit the (...) definition of a global commons, if viewed in a particular way; namely, as a biogeochemical resource system that sequesters carbon emissions. The question then arises whether land should be conceptualised as a global commons. I consider this question by reference to three contemporary problems of land justice (land grabbing, forced displacement, and unfairness in land-based climate mitigation); arguing that the global-commons framing will not be conducive to understanding or responding to these problems. I leave the question of how the global community should conceptualise land in the context of climate change open, claiming that any answer must include the voices and perspectives of those whose livelihoods and identities are closely connected to the land. This is an account of Sceptical investigation as it is presented by Sextus Empiricus. I focus attention on the motivation behind the Sceptic’s investigation, the goal of that investigation, and on the development Sextus describes from proto-Sceptical to Sceptical investigator. I suggest that recent accounts of the Sceptic’s investigative practice do not make sufficient sense of the fact that the Sceptic finds a relief from disturbance by way of suspending judgement, nor of the apparent continuity between proto-Sceptical and Sceptical investigation. In this article, evidence is briefly presented for three facts that together point to something puzzling. (1) That major continental philosophers of the nineteenth century tended to engage in some detail, as part of a broader preoccupation with ancient Greek thought, with Pyrrhonian scepticism. (2) That major continental philosophers of the twentieth century tended to engage in some depth with their nineteenth-century forebears and maintained their tendency to engage significantly with ancient Greek thought. (3) That twentieth-century continental philosophers demonstrate little (...) to no interest in Pyrrhonian scepticism. This raises the question: why does engagement with Pyrrhonism disappear from continental philosophy? The article discusses two hypotheses that might explain this disappearance. (shrink)

In this article I develop an interpretation of the opening passages of Hegel's essay ‘With what must the beginning of science be made?’ I suggest firstly that Hegel is engaging there with a distinctive problem, the overcoming of which he understands to be necessary in order to guarantee the scientific character of the derivation of the fundamental categories of thought which he undertakes in the Science of Logic. I refer to this as ‘the problem of beginning’. I proceed to clarify (...) the nature of the problem, which I understand to be motivated by a concern to avoid arbitrariness, and then to detail the nature of Hegel's proposed solution, which turns on understanding how the concept of ‘pure being’, understood in a specific sense to be both mediated and immediate, avoids the concerns about arbitrariness which accompany attempts to begin merely with something mediated, or merely with something immediate. On this basis, I offer a number of criticisms of alternative approaches to the beginning of Hegel's Logic. (shrink)

"What there is"-the traditional subject of metaphysics-can be determined only in context, Benoist contends, carving out a new path that rejects acontextual ontologies and approaches to the mind.

Paying special attention to the livestock industry, the author challenges the zootechnical denigration of animals for increased productivity awhile championing the collaborative nature of work. For Porcher, work is not merely a means to production but a means of living together unity. This unique reconsideration of work envisions animals as co-laborers with humans, rather than overwrought tools for exploitative, and often lethal, employment. Readers will learn about the disjunction between (...) those focused on productivity and profit and those who favor a more ethical work environment for animals. In discussions about responsibility for climate change, it is often suggested that the historical use of natural resources is in some way relevant to our current attempts to address this problem fairly. In particular, both theorists and actors in the public realm have argued that historical high-emitters of greenhouse gases (GHGs) – or the beneficiaries of those emissions – are in possession of some form of debt, deriving from their overuse of a natural resource that should have been shared more (...) equitably. These accounts of what might be termed ‘natural debt’ generally focus on one particular natural resource (global GHG sink capacity); invoke a principle of justice by which rights to consume this resource should have been allocated (most commonly, equal per capita shares); and then argue that historical violations of this principle give rise to certain rectificatory duties in the present (generally, duties on the part of those who have historically consumed an excessive amount of the world’s GHG sink capacity, or who have benefitted from such excess consumption, to offer some form of compensation to those who have not – such compensation usually taking the form of emission credits or cash). Though many seem to find it intuitively plausible that historical high-emissions have incurred some form of debt, significant challenges arise in rendering the concept of natural debt both coherent and defensible. Such problems are not, however, my focus in this piece. Instead, I here suggest that discussions about historical responsibility for climate change commonly fail to recognise certain other past injustices concerning natural resources that appear to hold contemporary relevance. In particular, I argue that it is not just the unequal consumption of global GHG sink capacity that may be of moral significance here; but also the way in which the world’s resources have more generally been governed. Animal production, especially pork production, is facing growing international criticism. The greatest concerns relate to the environment, the animals’ living conditions, and the occupational diseases. But human and animal conditions are rarely considered together. Yet the living conditions at work and the emotional bond that inevitably forms bring the farm workers and the animals to live very close, which leads to shared suffering. Suffering does spread from animals to human beings and can cause workers physical, mental, and also moral suffering, (...) which is all the more harmful due to the fact that it is concealed. The conceptual tools used to conceal suffering ( animal welfare, stress, pain) suggest that the industrial system can be improved, whereas for farmers it is by definition incompatible with animal husbandry. Many economists, it is said, “are inclined to deny that moral philosophy has anything to do with economics” . In this paper I challenge such inclinations bydrawing an analogy between economic interventions and humansubjects research. It is undeniable that investigators engaged in thelatter should adhere to specific ethical principles. I argue that analogousfeatures of economic interventions should lead us to recognise thatsimilar ethical concerns actually arise in both activities, and thusthat economic interventions should also be conducted in accordancewith ethical principles. By exploring the analogy further I formulatesome ethical guidelines for economic practice, which in turn imply thatethical responsibilities will extend to all members of the economicsprofession. Hegel opens the first book of his Science of Logic with the statement of a problem: “The beginning of philosophy must be either something mediated or something immediate, and it is easy to show that it can be neither the one nor the other, so either way of beginning finds its rebuttal.” Despite its significant placement, exactly what Hegel means in his expression of this problem and exactly what his solution to it is, remain unclear. -/- In this book, Robb (...) Dunphy provides a detailed engagement with Hegel’s “problem of beginning”, locating it within Hegel’s account of significant approaches to the topic of beginning in the history of Western philosophy, as well as making an extended case for the influence of Pyrrhonian Scepticism on the beginning of Hegel’s Logic. Dunphy’s discussion of the various putative solutions that Hegel might be thought to put forward contributes to debates concerning Hegel’s views on the methodology of logic, the relation between his Logic and his Phenomenology of Spirit, and differences between his Encyclopaedia presentation of logic and that of his greater Science of Logic. -/- Hegel and the Problem of Beginning also functions as a critical commentary on Hegel’s essay, “With what must the beginning of the science be made?” which should be of interest to both researchers and students working on the opening of Hegel’s Logic. In this paper, I offer a personal and professional narrative of how Canada went from prohibition to permission for medical assistance in dying. I describe the legal developments to date and flag what might be coming in the near future. I also offer some personal observations and reflections on the role and impact of bioethics and bioethicists, on what it was like to be a participant in Canada's law reform process, and on lessons that readers in other jurisdictions might take (...) from Canada's experience. In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

In this chapter, Robb Dunphy is concerned with the nature of G.E. Schulze's scepticism as he presents it in his 1792 work Aenesidemus, and with its relation to the metaphysical projects of Kant, Reinhold, and later German Idealists. After introducing Schulze's text, Dunphy turns to a recent interpretation offered by Jessica Berry, who claims that the extent to which Schulze endorsed a genuinely Pyrrhonian Scepticism has gone unacknowledged, both by his idealist contemporaries and by the majority of the (...) secondary literature on the period. Berry suggests that this unacknowledged Pyrrhonism in Aenesidemus provides the resources for a more radical criticism of the German Idealists' scientific, systematic metaphysical ambitions, to which they remain fundamentally vulnerable. Despite agreeing that an exploration of Schulze's debt to Pyrrhonism represents a valuable addition to our understanding of his scepticism, in the latter parts of the chapter Dunphy suggests that the Berry's attribution of a Pyrrhonian Scepticism to Schulze should to some extent be rejected, and that such a scepticism is perhaps not quite as problematic for the projects of Kant and the German Idealists as she suggests. Medical assistance in dying has received considerable attention from many in the field of bioethics. Philosophers, theologians, lawyers, and clinicians of all sorts have engaged with many challenging aspects of this issue. Public debate, public policy, and the law have been enhanced by the varied disciplinary analyses. With the legalization of MAiD in Canada, some attention is now being turned to issues that have historically been overshadowed by the debate about whether to permit MAiD. One such issue is voluntary stopping (...) eating and drinking as an alternative to MAiD. In this paper, I will apply a legal lens to the issue. An understanding of whether VSED is legal provides a foundation for ethical reflection on whether it ought to be permitted. Is it permitted for those who prefer VSED to MAiD? Is it permitted for those who do not qualify for MAiD under our current legislation – for those who do not have a grievous and irremediable medical condition, for mature minors, for individuals whose sole underlying medical condition is a mental disorder and who do not otherwise meet the eligibility criteria, and for individuals who have lost capacity but had completed an advance directive? Depression experienced by older adults is proving an increasing global health burden, with rates generally 7% and as high as 27% in the USA. This is likely to significantly increase in coming years as the number and proportion of older adults in the population rises all around the world. Therefore, it is imperative that the effectiveness of approaches to the prevention and treatment of depression are understood. Creative arts interventions, including art, dance movement, drama and music modalities, are utilised internationally (...) to target depression and depressive symptoms in older adults. This includes interventions led by trained arts therapists as well as other health and arts professionals. However, to date there has not been a systematic review that reports effects and examines the processes (why) and mechanisms (how) of creative arts interventions are used to address depression in this older age group. This systematic review of studies on creative arts interventions for older adults experiencing depression examined: outcomes of four creative arts modalities (art, dance movement, drama, and music); with particular attention paid to processes documented as contributing to change in each modality; and mechanisms considered to result from these processes. Our analysis of 75 articles (17 art, 13 dance, 4 drama and 41 music) indicates mostly significant quantitative or positive qualitative findings, particularly for interventions led by creative arts therapists. Mechanisms of change gleaned from the studies that were common across modalities include physical (e.g. increased muscle strength; neurochemical effects, such as endorphin release), intra-personal (e.g. enhanced self-concept, strengthened agency and mastery; processing and communication of emotions), cultural (e.g. creative expression, aesthetic pleasure), cognitive (e.g. stimulation of memory) and social (e.g. increased social skills and connection), that were all considered to contribute to reduced depression and symptoms. Recommendations for future research include a stronger focus on testing of processes and mechanisms. (shrink)

The question of whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying has recently come to the fore in debates about the legalisation of assisted dying. For example, it was central to critiques of the 2021 amendments made to Canada’s assisted dying law. The question of whether changes to a country’s assisted dying legislation lead to descents down slippery slopes has also come to the fore—as it does any time a jurisdiction (...) changes its laws. We explore these two questions through the lens of Canada’s experience both to inform Canada’s ongoing discussions and because other countries will confront the same questions if they contemplate changing their assisted dying law. Canada’s Medical Assistance in Dying law has evolved through a journey from the courts to Parliament, back to the courts, and then back to Parliament. Along this journey the eligibility criteria, the procedural safeguards, and the monitoring regime have changed. In this article, we focus on the eligibility criteria. First, we explain the evolution of the law and what the eligibility criteria were at the various stops along the way. We then explore the ethical justifications for Canada’s new criteria by looking at two elements of the often-corrosive debate. First, we ask whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying of decisionally capable people with mental illnesses and people with disabilities as their sole underlying medical conditions. Second, we ask whether Canada’s journey supports slippery slope arguments against permitting assisted dying. All data relevant to the study are included in the article. (shrink)

This paper argues firstly that the argument of Hegel's Phenomenology of Spirit is necessary for the justification of the beginning of his logical project, and secondly that Hegel's attempt to secure the beginning of his Science of Logic by relying upon the argument of the Phenomenology fails. I argue firstly that the position taken up at the beginning of Hegel's Logic is constructed in such a fashion that it relies upon the argument of the Phenomenology to justify it. I then (...) offer some support for the view of the relationship between the two texts defended by Maker in order to see how the two might be thought to be compatible. Finally, in the longest part of the paper, I offer a number of reasons for thinking that attempts to render the two compatible in this fashion fail. I therefore conclude that, as it stands, the beginning of Hegel's Logic is not secured against objection in the way that Hegel wants it to be. (shrink)

In this paper I discuss a popular position in the climate justice literature concerning historical accountability for climate change. According to this view, historical high-emitters of greenhouse gases—or currently existing individuals that are appropriately related to them—are in possession of some form of emission debt, owed to certain of those who are now burdened by climate change. It is frequently claimed that such debts were originally incurred by historical emissions that violated a principle of fair shares for the world’s natural (...) resources. Thus, a suitable principle of natural resource justice is required to render this interpretation of historical accountability complete. I argue that the need for such a principle poses a significant challenge for the historical emission debt view, because there doesn’t appear to be any determinate answer to the question what a fair share of climate sink capacity would have been historically. This leaves the historical emission debt view incomplete and thus unable to explain a powerful intuition that appears to motivate the view: namely, that there is something unjust about how the climate sink has historically been used. I suggest an alternative explanation of this common intuition according to which historically unequal consumption of climate sink capacity, whether or not wrongful in and of itself, is a symptom of broader global injustice concerning control over and access to the world’s natural resources. This broader historical injustice will be harder to quantify and harder to repair than that which the historical emission debt purports to identify. (shrink)

It requires considerable time, effort, and energy and carries with it significant physical and psychological risks. In very general terms, one cycle of egg production and retrieval involves an estimated total of 56 hours for interviews, counseling, and medical procedures. The screening carries risks of unanticipated findings with severe consequences for insurability. (...) Neuroimaging has provided insight into numerous neurological disorders in children, such as epilepsy and cerebral palsy. Many clinicians and investigators believe that neuroimaging holds great promise, especially in the areas of behavioral and cognitive disorders. However, concerns about the risks of various neuroimaging modalities and the potential for misinterpretation of imaging results are mounting. Imaging evaluations also raise questions about stigmatization, allocation of resources, and confidentiality. Children are particularly vulnerable in this milieu and require special attention with regards to safety (...) guidelines and modality adaptations. This article examines pediatric neuroimaging practice through an ethics lens. Most authors in the field of neuroethics focus on the future concerns of neuroimaging. In contrast, our paper examines ethical matters surrounding current clinical applications in the pediatric population. We first provide a brief overview of the neuroimaging technologies most commonly used in a pediatric clinical context and then discuss a variety of ethical issues arising from the use of these technologies.
